JUDGMENT Rajiv Sharma, J. Mr. B.C. Negi, learned counsel for the petitioner prays for and is permitted to withdraw the present petition in order to enable his client to avail the statutory remedy under the Himachal Pradesh Panchayati Raj (Election) Rules, 1994. The petitioner shall file election petition within a period of one week from today and thereafter the replies shall be filed by the respondents within a further period of two weeks. Rejoinder, if any, shall be filed by the petitioner within a period of one week thereafter. The S.D.O., Shillai, District Sirmour, before whom the election petition is to be filed, is directed to decide the election petition within a total period of 45 days, positively. 2. Consequently, in view of above observations made hereinabove, the present petition is dismissed having been withdrawn, so also the pending application(s), if any. No costs.
