JUDGMENT :- 1. The petitioner has come to this Court seeking issuance of a writ of Certiorarified Mandamus, questioning the order passed by the second respondent/the Executive Engineer, Public Works Department, Mettur Dam, Salem District in his proceedings No.11783/96/E1/(2583/04) dated 13.10.2004 and to quash the same and with a further direction to the respondents to allot the quarters in which the petitioner is residing on outright sale basis. 2. When the matter was taken up for hearing, the learned counsel appearing for the petitioner after some arguments, made a request to this Court to grant him some breathing time to vacate the quarters as he has not made any suitable arrangements for alternative accommodation. 3. The learned Additional Government Pleader objected the plea of the petitioner on the ground that the petitioner has been sufficiently granted so much of time. 4. Considering the submissions made on both sides, this Court permits the petitioner to file an affidavit of undertaking to vacate the quarters within a week from the date of receipt of a copy of this order. On filing such an affidavit, the respondents shall not evict the petitioner from the quarters for a period of three months from today. It is also made clear that if the petitioner fails to submit an affidavit of undertaking within a week, the respondents shall obtain forceable possession of the quarters. However, the petitioner is also directed to pay the monthly rent to the quarters for the extended period of three months. With this observation and direction, the Writ Petition is disposed of. Consequently, connected Miscellaneous Petitions are also closed. There shall be no order as to costs.
