ORDER 17.1.2011 — Heard learned counsel for the parties. In both the writ applications the question for consideration was as to whether the General Manager (Administration), OSRTC can be authorized to exercise the powers of the appellate authority in respect of Bhubaneswar and Berhampur Division in addition to his own duties. Admittedly under the Rules, the Divisional Managers are the appellate authorities in respect of the respective Divisions. In absence of the Divisional Managers, the General Manager (Administration) had been authorized to act as the appellate authority. During pendency of the writ applications, on 4.8.2010 two officers have been promoted to the post of Divisional Managers, OSRTC, one at Berhampur and the other at Sambalpur. Since under the Rules, the Divisional Manager of the Division is the appellate authority, all appeals pending before the General Manager (Administration) for disposal be transmitted to the office of the two Divisional Managers for disposal in accordance with law. So far as Cuttack Division is concerned, if any Divisional Manager is available, he may decide the appeals or in the alternative one of the said two officers at Berhampur or Sambalpur be authorized to deal with the appeals of Cuttack Division. With the above direction, both the writ applications are disposed of. Urgent certified copy of this order be granted on proper application. Application disposed of.
