ORDER : G.S. Singhvi, A.K. Ganguly, JJ. Heard learned counsel for the parties and perused the affidavit of Shri D.R. Veeranna, Additional Director (Minerals), Department of Mines and Geology, Karnataka and accompanying documents. 2. Annexures R-1 and R-2, filed with the affidavit of Shri Veeranna, show that in all 6 persons were granted leases to operate mines within 1 kilometer radius of Shri Jambunatheswara temple at Hospet and three persons were granted leases to operate within the radius of 1 to 2 kilometers. The persons named in Annexures R-1 and R-2 are ordered to be impleaded as parties. 3. Notice be issued to M/s. Mysore Minerals Ltd., Smt. R. Mallamma, Sri R.J. Pattabhiramaih, Sri Allam Basavaraj, M/s. R.B.S.S.N. Das, Sri R. Charuchandra, Sri H.N. Prem Kumar and M/s Kariganur Mineral Mining Industries, returnable in four weeks. 4. The Learned counsel for the petitioner shall take steps for filing process and spare copies within three days. Notice be given to the counsel for the State of Karnataka for ensuring service upon the newly added parties. 5. In the meanwhile, the State of Karnataka and its functionaries are directed to ensure that all mining operations within two kilometers radius of Shri Jambunatheswara temple are stopped forthwith. This would mean that the State Government shall take steps to stop mining operations by M/s. Mysore Minerals Ltd., Smt.R.Mallamma, Sri R.J.Pattabhiramaih, Sri Allam Basavaraj, M/s. R.B.S.S.N. Das and Sri R. Charuchandra, Sri H.N. Prem Kumar and M/s Kariganur Mineral Mining Industries. If M/s. Mysore Minerals Ltd., Sri R.J. Pattabhiramaih and Sri Allam Basavaraj are not carrying mining operations, this order will not operate qua those lessees. 6. The case be listed on 18-03-2011 for the purpose of considering the issue relating to constitution of the committee.
