ORDER 1. Argument on first bail application under S. 439 of the CrPC filed by applicants Shaikh Nisar and Javed Patel heard. 2. The applicants are involved in Crime No. 95/11 registered at PS Roshan Nagar-B, Khajrana Indore under S. 363, 366, 376 of IPC and S. 3 (1) (2) and 3 (2) (5) of SCST (Prevention of Atrocities) Act. 3. According to prosecution case from 8.3.11 Babita was missing from her house and she was seen going with Sikandar. Hence, on report by her father, above offence was registered. After recovery of Babita, it revealed that she was enticed by Sikandar and thereafter she went Indore by bus there Javed took her to his house where at 11.00 p.m. Sikandar came. After some time Sikandar took her to the roof of the house and then to a room where he committed rape with her. Next day on 9.3.11 he took her to other place where he stayed for whole day. In the evening they went to the house of Javed. There his family members refused to stay in their house. Then Sikandar took her to another room in Khajrana. In the night police came and recovered Babita. Hence, applicant has been arrested. 4. It has been argued on behalf of the applicant that applicant has been falsely implicated in the case. They have not committed rape. Sikandar and Babita stayed at their house. Trial will take time. Hence, they should be released or bail. 5. Respondent/State has opposed the bail application. 6. Considering the circumstances and after perusal of the case diary and the evidence collected, the application is allowed. It is ordered that applicants be released on bail on each furnishing bail bond of Rs. 25,000/- with one surety by each in the like amount to the satisfaction of the trial Court for their appearance before the said Court on all dates as maybe fixed.
