Judgment :- 1. Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus forbearing the respondents 1 and 2 from sanctioning the application submitted by the third respondent for an agricultural electricity service connection to the common well situated in survey No.75/7, Murugananthal village, Arni Taluk, Tiruvannamalai District in violation of regulation 27(2) of the Tamil Nadu Electricity Distribution Code, 2004. 2. Heard the learned counsel appearing for the petitioner and Mr.P.Srinivas, learned counsel appearing for the respondents 1 and 2. By consent of both parties, the writ petition is taken up for final disposal. Notice to the third respondent is dispensed with in view of the nature of order that is to be passed safeguarding his interest. 3. The claim of the petitioner is that he is the co-owner of the property and the third respondent seeks separate agricultural electricity power supply and the authorities are intending to effect such supply in violation of the Tamil Nadu Electricity Power. Petitioner has sent a legal notice dated 3.12.2010 to the respondents 1 and 2. Since the authorities have already been put on notice by the petitioner, learned counsel for the petitioner, therefore, submitted that the grievance of the petitioner will be met if the said legal notice/representation is considered by the authority on merits. 4. In view of the submission made by the petitioner's counsel, the authority shall consider the legal notice dated 3.12.2010 on its own merits and in accordance with law. Before proceeding to decide the issue, the authority shall hear the third respondent and decide the issue with regard to the objection raised by the petitioner. It is made clear that the Court has not expressed anything on the merits of the petitioner's claim. The writ petition is disposed of accordingly. No costs. Consequently connected miscellaneous petition is closed.
