Judgment DAYA CHAUDHARY, J. 1. The present petition under Section 482 Cr.P.C. has been filed for issuing appropriate directions to the official respondents to investigate the matter and take action against respondent No.4 for committing the murder of Mahant Jeet Nath @ Ajit Nath Chela Baba Shamsher Nath, incharge of small dera in village Kailram, District Kaithal. 2. Notice of motion was issued on 17.9.2010. 3. Learned counsel for the petitioner contends that the investigation in the case has not been properly conducted and immediately after the death of Mahant Jeet Nath @ Ajit Nath, an attack was made on the Dera. Learned counsel for the petitioner further contends that the deceased died in mysterious circumstances and the matter be got investigated properly. 4. In response to the notice issued, reply on behalf of respondents No.1 to 3 has been filed, wherein, it has been mentioned that the deceased was ill and was admitted in a private hospital at village Meham and died there only. The post mortem was conducted in Civil Hospital, Kaithal and as per opinion given by the Doctor, the deceased died due to gastric perforation of stomach. The viscera was also sent to the chemical examiner to explore any other reason. Enquiry has also been conducted on the complaint made by the petitioner by DSP (Hq), Kaithal, wherein, all the allegations were found false. 5. In view of the above, learned counsel for the petitioner prays that he may be permitted to withdraw this petition with liberty to file private complaint. 6. Dismissed as withdrawn with the aforesaid liberty.
