JUDGMENT 1. - This criminal misc. petition has been filed under Section 482 Cr.P.C. seeking quashing of charge sheet No. 214 dated 8.11.2005 filed by Superintendent of Police, Anti Corruption, Bikaner and also the order Annex. 7 dated 29.3.2005 sanctioning prosecution of the petitioner, who at the relevant point of time was working as SDO (South), Bikaner, under Sections 420, 477 and 120-B I.P.C. read with Sections 13(1)(d) and 13(2) of the Prevention of Corruption Act. 2. This petition is pending in this Court for last five years for admission purpose and except one detailed order sheet dated 5.12.2006 noticing contention,- of learned counsel for the petitioner, nothing except adjournments has happened in this case. There is no interim order in favour of present petitioner staying the trial in the competent Court. 3. Today, learned counsel for the petitioner appeared and argued the case for admission.

He submitted that the petitioner, at the relevant point of time, working as SDO (South), Bikaner' had only decided the suit filed by the co-accused Nain Giri and his order has been upheld by the competent authority in the Government and, therefore, he has not committed any alleged offence and the charge sheet against him and others and order sanctioning prosecution deserve to be quashed by this Court in its jurisdiction under Section 482 Cr.P.C. The above facts noticed by the competent authority in regard to Criminal Case No. 2/1999 are startling and prima fncie show how the petitioner in collusion with plaintiff Nain Giri and others himself became a party to the long drawn legal battle in which the said Nain Giri changing the stand at various point of time and concealing the fact of previous litigation and orders, succeeded in getting the land belonging to temple known as "Karni Mata Temple" and got it recorded in his name and also got the mutation entries in his favour pursuant to order passed by the petitioner on 6.3.1998 after the said Nain Giri was granted permission to withdraw the previous suit No. 203/1984 on 20.1.1998, which was pending for last 14 years and in which relevant evidence, which could have dislodged the claim of plaintiff Nain Giri altogether, was suddenly put to an abrupt end and concealing these material facts, a fresh plaint was got filed before the petitioner, who was working as SDO (South) Bikaner, who not only passed decree in favour of co-accused Nain Giri within 6 days but got the same executed and relevant mutation entries recorded in the revenue record by apparently showing that he has proceeded on leave and as he did not get the train reservation went to Tehsil Office, Nokha and got the mutation entries entered in favour of beneficiaries of such decree. 5. It is indeed unfortunate that against such corrupt officials when the legal process started to taken its logical end and sanction of prosecution was accorded by the competent authority, the petitioner appears to have left no stone unturned in his way to stall the proceedings and it appears that to scuttle such legal process, he took shelter of the order passed by some competent authority above him in the Government and succeeded in getting the land of temple (perpetual minor deity) recorded in plaintiff Nain Giri's name and started selling the portion of his land for commercial purposes and earning profits. Some of the land was sold to petitioner's own relatives possibly as Benami transaction. This is how the corrupt official is trying to push the things under the carpet and the length of litigation is the success, for such people. 6. For last six years this misc. petition is pending in this Court and has not been argued for admission purpose and despite their being no interim order in favour of the petitioner, the progress of the trial in the present case is not placed before this Court. It goes without saying that in view of detailed and cogent reasons given by the competent authority, as quoted above, the impugned order does not require any interference by this Court under Section 482 Cr.P.C. and there is absolutely nothing which would require quashing of these proceedings by this Court. Such frivolous criminal misc. petition, in fact, deserved to be dismissed in the very first instance, lest the mere pendency of the same could adversely affect the progress of the trial. 7. In view of the above, this Court is satisfied that there is no merit in the present criminal misc. petition and same is accordingly dismissed with cost of Rs. 25,000/-, which shall be paid by the petitioner to respondent State within three months. 8. The learned trial Court is directed to conclude the trial expeditiously and send a report to this Court within a period of three months from today, which may be placed before this Court for perusal on 25.5.2011. 9. Copy of this order be sent to the Dy. Secretary (Personnel) (K-3) Department, Secretariat, Jaipur, who passed the impugned order on 29.3.2005, who shall also submit a report of action taken against the petitioner within three months.Petition dismissed. *******
