Judgment :- 1. The petitioner has prayed that the temporary permit granted in favour of the fourth respondent to lift the ordinary sand deposited in the patta lands in Sy.No.1, over an extent of 7.13 guntas of Wajidnagar Village, Bichkunda Mandal, Nizambad District, vide memo No.17798/SPIU&SAND/2010-11, dated 17.03.2011, be cancelled. 2. It has been averred that there is no provision to grant temporary permit in favour of any person as there are no Rules by which temporary permits can be granted. 3. Learned Government Pleader for Mines and Geology appearing for respondents, on the other hand, submits that the lands for which temporary permit was granted in favour of the fourth respondent are private patta lands and as per the policy of the State Government, the temporary permits can be granted. He also placed reliance on a judgment rendered by a division Bench of this Court in Writ Appeal No.140 of 2011 on 28.03.2011, wherein it has been held that the policy decision of the Government does not in any way run contrary to the Rules, and permits can be granted to the pattadars, which, in the present case is the A.P. Mineral Development Corporation. It is further held that ample check and necessary safeguards have been provided with regard to the minor minerals and it is not a case where any permission has been granted directly in favour of the pattadars. It is also held that as the land is private patta land, the writ petitioner does not have the locus standi vis-à-vis the Mineral Development Corporation in favour of whom the permits have been granted. 4. This case is squarely covered by the decision of a Division Bench of this Court in W.A.No.140 of 2011, dated 28.03.2011, and accordingly, the writ petition is dismissed. However, there shall be no order as to costs.
