JUDGEMENT Sheema Ali Khan, J. 1. In view of the fact that the order dated 08.09.2000 with respect to similarly situated co-accused Rameshwar Prasad, Surendra Kumar Singh and Chandra Mohan Shahi has been quashed by this Court vide order dated 11.08.2010 passed in Criminal Misc. No. 30293 of 2000 on the ground that the present Complaint Case No. 1006 of 1999 amounts to a malicious prosecution, this Court quashes the order of cognizance dated 08.09.2000 with respect to the aforesaid complaint case as the facts of both the cases are the same. 2. This quashing application is accordingly allowed in terms of the order passed in Criminal Misc. No. 30293 of 2000, disposed of on 11.08.2010.
