Judgment :- 1. The petitioner herein has been transferred by the order dated 24.04.2008, thereafter the petitioner made a representation dated 08.12.2009 requesting the respondent to consider his case for retransfer. Since the petitioners representation has not been considered and no order was passed, the petitioner has come forward with the present writ petition. 2. Learned Government Advocate for the respondent submitted that the petitioner has been transferred and in pursuance of the vigilance enquiry pending, the vigilance commission has forwarded the report to the Government. However, the learned counsel for the petitioner submitted that after filing of the counter affidavit by the respondent charges have been framed and the case has been taken on file in TTP.No.15 of 2009 by the Office of the Commissioner for the criminal proceedings, the petitioner being the third accused has been attending the proceedings. 3. Considering the limited scope of the prayer and without going to the merits of the case and taking into consideration of the representation made by the petitioner, the petition is yet to be disposed of. The respondent is directed to consider and pass orders on the representations made by the petitioner dated 22.01.2009 and 08.12.2009, within a period of eight weeks from the date of receipt of a copy of this Order. 4. With the above observation, the writ petition is disposed of. No costs.
