Judgment :- 1. Heard both the learned counsel appearing for the petitioners as well as the respondent. 2. Challenging the order, dated 16.11.2009 passed in R.C.A.No.753 of 2006 on the file of the Rent Control Appellate Authority / VII Judge, Court of Small Causes, Chennai, confirming the fair and decretal order, dated 21.06.2006 made in R.C.O.P.No.1618 of 2005 on the file of the Rent Controller / XI Judge, Court of Small Causes, Chennai, this revision has been preferred by the petitioners. 3. When the matter was taken up for arguments, learned counsel appearing for the petitioners filed a memo, dated 28.01.2011 signed by both the revision petitioners and the learned counsel appearing for the petitioners. 4. As per the memo filed on behalf of the petitioners, (i) the petitioners herein have agreed to vacate and hand over the R.C.O.P premises to the respondent on or before 08.02.2011. (ii) the petitioners have no objection to permit the respondent to withdraw the amount, Rs.90,000/- deposited by them to the credit of R.C.O.P.No.1618 of 2005. Learned counsel appearing for the petitioners submitted that orders be passed in the civil revision petition, as per the memo filed by the petitioners. 5. Learned counsel appearing for the respondent / landlord having taken notice, has raised no objection for orders being passed, as per the memo filed by the petitioners herein, accordingly, this revision petition is ordered. 6. On the aforesaid facts and circumstances, the petitioners / tenants herein are directed to vacate and hand over the R.C.O.P premises on or before 08.02.2011 to the respondent / landlord and the respondent / landlord is permitted to withdraw the sum of Rs.Rs.90,000/- deposited towards arrears of rent by the revision petitioners / tenants to the credit of R.C.O.P.No.1618 of 2005. 7. With the above observations, this Civil Revision Petition is disposed of. Consequently, connected miscellaneous petitions are closed. No costs.
