JUDGMENT Kurian Joseph, J. The writ petition is filed with the following prayers:- i) That the order dated 9.9.2010 (Annexure P-6) passed by respondent No. 3, Sub Divisional Officer (Civil) Nahan, may kindly be quashed and set aside. ii) That the respondents may kindly be directed to pay compensation to the tune of Rs. 1.00 lacs to the petitioner as provided under the Scheme as has been done in the similarly situated cases earlier by respondent No.3.” 2. It is seen that the petitioner has filed an appeal against the order of the third respondent and the same is now pending before the second respondent. According to the petitioner, in similar circumstances, the compensation has been given and one such instance is Annexure P-9. It is for the second respondent, appellate authority to consider all these aspects. Therefore, this writ petition is disposed of directing the second respondent to take a final decision on Annexure P-12, appeal with notice to the petitioner and after adverting to all the contentions taken by the petitioner. The needful, as above shall be done within a period of three months from the date of production of copy of this judgment and the copy of the writ petition, by the petitioner before the second respondent. 3. The writ petition is disposed of, so also the pending application (s), if any.
