Judgment :- 1. This Civil Revision Petition is filed praying direction to direct the Subordinate Judge, Ranipet to dispose E.P.No.318 of 2003 in O.S.No.27 of 2000 on the file of Subordinate Judge at Ranipet, Vellore District within a stipulated period. 2. By order dated 21.9.2011, this Court passed the following order:- “It is represented by the learned counsel for the petitioner shall serve papers on the counsel appearing for the respondents before the court below, informing him that the revision will be taken up for disposal on 26.9.2011. Post on 26.9.2011.” 3. Thereafter service was effected on the lower court counsel and his name is also printed in the cause list. However, none appears on behalf of the respondents. 4. Learned counsel for the revision petitioner states that the E.P.No.318 of 2003 has been filed in the year 2003 and it is pending for a long number of years. Hence, he states that the court below should be directed to dispose of the E.P. within a stipulated time. 5. On verification of the Execution Petition No.318 of 2003 and orders thereon enclosed in the typed set of papers, an application E.A.No.95 of 2011 filed under Section 47 CPC is pending. Without disposing the said E.A., the court below cannot take the E.P. for disposal. 6. In view of the above, the court below is directed to dispose the E.A.No.95 of 2011 first expeditiously and then take the E.P. for disposal at an early date. The Civil Revision Petition is disposed of as above. No costs.
