Judgment :- 1. Writ Petition is filed to issue a Writ of Mandamus directing the 1st and 2nd respondents to receive, process and consider for effecting water and Sewerage connections to the petitioners premises at Plot No.2, Nehru Avenue, Bharathidasan Colony, K.K. Nagar, Chennai 600 078 without insisting on production of completion certificate/NOC from the 3rd respondent.2. The petitioner seeks water and drainage connection stating that he obtained sanction for demolition and re-construction from the Corporation of Chennai vide PPA/WDC 09/06140/2007 dated 01.12.2007 and put up construction of Ground and two floors. Therefore, there is no need for getting Completion Certificate/No Objection Certificate from the third respondent Chennai Metropolitan Development Authority. The Chennai Metropolitan Water Supply and Sewerage Board, the respondents 1 and 2 are insisting on Completion Certificate/No Objection Certificate for the above said premises.3. Heard Mr.J. Ravindran, learned counsel appearing for the third respondent Chennai Metropolitan Development Authority states that since the building does not come within the purview of the special building or multi-storied building, the question of Completion Certificate/No Objection Certificate being issued by the Chennai Metropolitan Development Authority does not arise.4. In such view of the matter, the respondents 1 and 2 are directed to provide the water supply and sewerage connection if the application is otherwise in order. The Writ Petition is ordered as above. No costs.
