Judgment :- 1. The petitioner filed O.A.No.6006 of 2001 seeking for a direction to the respondents to include the name of the petitioner in the panel for promotion and upgradation of the Grade I Police Constable as Head Constable for the year 1994 and consequently direct the respondents to promote him from Grade I Police Constable to Head Constable with effect from 14.1.1998 with all benefits. 2. Even according to the petitioner, disciplinary action was initiated during the year 1993 under Rule 3(b) of the Tamil Nadu Police Subordinate Service (D&A) Rules 1955. The disciplinary action ended in passing of the order dated 24.10.1997 imposing the punishment of reduction in the time scale of pay for two years with cumulative effect. The said order came into effect from 18.9.1997 and was in operation upto 18.9.1999. Since a disciplinary proceeding was pending and later resulted in the punishment, the petitioner is not entitled for the relief, which he has sought for in the writ petition. Accordingly, the writ petition fails and the same is dismissed. No costs.
