Judgment : The Court : The petitioner in this art.226 petition dated March 23, 2011 is alleging inaction on the part of the Collector, Hooghly in that the Collector has not considered her application dated December 21, 2010 (at p.26) for grant of licence to work as a stamp vendor. The petitioner requested the collector to consider the question of granting her licence in terms of the Government Order dated August 22, 1997 (at p.22) on the grounds that in view of her father’s illness she is entitled to consideration under provisions of cl.(c) of para.9 of the Government Order. It seems to me that the petitioner was entitled to apply for grant of licence in terms of para.9(c) of the Government Order. In my opinion, the collector ought to have considered the petitioner’s case. I think it will be appropriate to dispose of the petition directing the Collector to decide the petitioner’s application. For these reasons, I dispose of the petition ordering as follows. Within ten weeks from the date of communication of this order and after giving the petitioner a reasonable opportunity of hearing, the Collector shall decide the petitioner’s application dated December 21, 2010 giving a reasoned decision that shall be communicated to the petitioner at once. No costs.
