JUDGMENT Kurian Joseph, C.J. The petitioner has approached this Court seeking family pension but it is seen that late husband of the petitioner was not a pensioner. Unless the petitioner is eligible family member of the pensioner, family pension cannot be granted. The case of the petitioner is that husband of the petitioner late Sh. Ruldu Ram had serviced from 1943 to 1962 and only on medical ground he had tendered resignation. It is the case of the petitioner that such resignation should be treated as request for voluntary retirement since there were no compelling circumstances for late Sh. Ruldu Ram to tender resignation. It is further submitted that before accepting the resignation this aspect of the matter should have been considered by the Government. In view of the intervening developments the petitioner is free to represent before the Government since the husband of the petitioner expired in the year 1993. In the event of the petitioner filing such comprehensive representation within six weeks from today the matter be duly considered by the first respondent and appropriate action in accordance with law and justice be taken within another four months. 2. Petition stands disposed of so also the pending applications, if any.
