Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondents not to issue a direction to the fleet owners of all the buses including the Government buses to ply from the new bus stand instead of old bus stand from 1.2.2011 onwards for the purpose pavement of cement concrete floor. 2. Mr.G.Sankaran, learned Special Government Pleader takes notice on behalf of the first respondent. Mr.L.S.M.Hasan Fizal, learned Government Advocate takes notice on behalf of the second respondent. By consent of both the parties, the writ petition is taken up for disposal. 3. Petitioner has filed the writ petition setting out the grievance that the shifting of the bus-stand from the old to new bus-stand will cause great hardship and prejudice to the shop owners in the old bus terminus. 4. Mr.G.Sankaran, learned Special Government Pleader appearing for the first respondent on instruction produced a copy of the proceedings Na.Ka.No.,1/8576/2005 dated 28.01.2001 in which the Commissioner, Thirupur Corporation has indicated the procedure to be followed in this matter and the same is extracted as hereunder:- "According to decision taken in the Road Safety meeting which was conducted by the Tiruppur District work Collector on 28.1.2001 it was decided take up the execution of above in three phases as detailed below:- During the Ist Phase of execution of work all Town buses will ply continuously in Old Bus-stand. Mofussil Buses which were parked at execution portion should drop passengers in Old Bus-stand and go to New Bus-stand for rest and return back to Old Bus stand for pickup the passengers at the departure time. During the IInd and IIIrd Phases of executing work all Town buses will ply continuously in Old Bus-stand and the same manner will be followed for Mofussil Buses as said in I Phase. On the above circumstances, the business of the petitioners is not affected and the above time bound work will be completed as directed by the government....." 5. Recording the above submission made by the first respondent in writing, the writ petition is closed. Consequently, connected miscellaneous petition is also closed. No costs.
