Judgment :- 1. This Civil Revision Petition is filed challenging the Judgment and Decree dated 9.12.2010 passed in R.C.A.No.16 of 2008 on the file of the Principal Sub Court, Chengalpattu, confirming the order and decreetal order dated 24.1.2008 passed in R.C.O.P.No.3 of 2005 on the file of the District Munsif, Chengalpattu. 2. The first revision petitioner/tenant has filed an affidavit of undertaking for himself and on behalf of the second revision petitioner and the relevant portion reads as follows:- “1. I am the 1st petitioner herein and I know the facts of the case. I am filing this Affidavit on behalf of the 2nd petitioner. The 2nd petitioner is my brother. He is not working with me in the premises. 2. It is humbly submitted that I have filed the above Revision against the concurrent finding of the Courts below. I have settled the dispute with my landlord. My landlord agreed to grant time for 12 months to vacate the premises. I have agreed to pay the monthly rent of Rs.1,650/- without any default. Under these Circumstances I hereby undertake to vacate and hand over the vacant possession of the shop premises within 12 months (i.e.) on or before 2012 December.” 3. The affidavit of undertaking is recorded. In view of the affidavit of undertaking as above, the revision petitioners/tenants are granted 12 months time from today to vacate and hand over possession without demur to the respondent/landlord. 4. The revision petitioners/tenants are also directed to pay the monthly rent to the landlord as undertaken by the revision petitioners, if there is failure to pay the rent, the respondent/landlord is at liberty to proceed with the matter in accordance with law immediately. The affidavit of undertaking will be form part of the records. 5. This Civil Revision Petition is disposed of as above. No costs. Consequently, connected miscellaneous petition is closed.
