JUDGMENT K. Bhakthavatsala and K. Govindarajulu, JJ.—The petitioner is before this Court praying for issue of a writ of mandamus to respondent No. 1 to renew the quarry lease bearing No. KPL. TCA : SL-4B as per Annexure "A" by considering the application filed by him as per Annexure 'B" dated 23.3.2010. Learned Counsel for the petitioner submits that the petitioner was granted lease for quarrying ordinary sand as per the licence as per Annexure "A". But, the petitioner could not lift sand on the ground that there was continuous flow of water in the river. In pursuance of the lease agreement, the petitioner has deposited a huge amount of Rs. 23,50,000/- with the Mines and Geology Department and therefore, the petitioner made an application dated 23.3.2010 praying for renewal of the quarry lease, but the respondents have not yet considered the petitioner's application. 2. Learned Government Advocate submits that as per the Government policy, the Government has decided to auction the quarry lease of lifting sand and apart from that, the licence granted in favour of the petitioner for a period of one year is over and there is no good ground for renewal of the lease. 3. Admittedly, the lease period of one year granted in favour of the petitioner expired on 27.4.2010. The quarrying licence granted in favour of the petitioner does not give any such right of renewal of licence. Under such circumstances, there is no merit in the writ petition. In the result, writ petition fails and the same is hereby dismissed. Sri. N.B. Viswanath, learned AGA is granted three weeks' time to file memo of appearance for respondents.
