JUDGMENT J.K. Maheshwari, J. 1. Shri Anoop Shrivastava, Advocate for the petitioner. Shri Ashok Kumar Chourasiya, Government Advocate for respondents/State on advance notice. 2. Being aggrieved by inaction to settle the retrial dues and pension finally, the Petitioner has come before this Court. It is stated that he has attained the age of superannuation on 31.5.2010. The pension and the retrial dues is required to be settled but it has been delayed and by passing the order Annexure P/3, 90% provisional pension and provisional gratuity has been released. It is the grievance of the Petitioner that the said action to release the provisional pension and gratuity is unsustainable in law and the Respondents may be directed to finalize the post retrial dues and pensioner benefits in full and final. 3. On the other hand Shri Chourasiya, learned Government Advocate appearing on behalf of the Respondents/State contends that this, petition may be disposed of with a direction to the Respondents to take a final decision within time frame. 4. Considering the aforesaid, this petition is disposed of with a direction to the Respondents to finalize the retrial dues and pensioner benefits of the Petitioner now within a period of three months from the date of communication of the certified copy of this order. With the aforesaid, the petition stands disposed of.
