JUDGEMENT 1. Heard the parties. 2. The order passed by us on 21.12.2010 should be treated as part of this order for the sake of brevity and to avoid unnecessary repetition. 3. As the earlier order indicates, we had indicated our views on the basis of materials available on record and after hearing the parties but we kept our views non conclusive and tentative in view of prayer of learned counsel for the State for one more opportunity to seek further instructions, particularly, from the Principal Secretary, Department of Revenue and Land Reforms. Today, learned counsel for the State has fairly submitted that he communicated the order dated 21.12.2010 to the Chief Secretary for further materials by way of instructions, if required. He has submitted that he has not been given any instruction and no further materials can be placed before this Court even today. 4. Having heard the parties, we are of the view that the order passed on 21.12.2010 is fit to be reiterated as our final order. Accordingly, this writ petition is disposed of with a direction that the Civil Court building in Bhabhua town in the district of Kaimur shall continue at its present location and five acres of adjacent land of the dilapidated SDO building should be made available for expansion of the Civil Court campus and construction of further building without any delay and in any case within three months from today. It is further made clear that if 10 acres of land nearby agriculture farm slightly outside the town is acquired, the same or a suitable part of it should be considered to be transferred for the purpose of construction of residential colony for the judicial officers in future.
