JUDGMENT : This petition is directed against the orders date d 21-09-2007 and 27-09-2007; whereby, petitioner, an employee of South Easter Coalfields Ltd. has been transferred from Pali Project Johilla Area to Bhatga wan Area, which is at a distance of about 500 Kms. On 14-12-2007 while issuing notice on admission an interim relief was granted to the petitioner, whereby, operation of impugned orders was stayed. It appears that by virtue of the said order since then the petitioner has continue to work at Pali Project Johilla Area. In view whereof, the impugned orders having lost its efficacy are hereby quashed. The respondents are, however, at liberty to pass fresh order in case the exigency of service so warrants. The petition is allowed to the extent above. Certified copy as per rules.
