JUDGMENT Rajiv Sharma, Judge Case of the petitioner, in a nut-shell, is that a sum of Rs.50,000/- has been ordered to be recovered from his salary without following the provisions as laid down in Rule 39 of the H.P. Tourism Development Corporation Limited (Staff) Regulations, 1972. Once the procedure has been prescribed in the Rules, the same should be scrupulously followed and adopted. 2. Consequently, the petition is disposed of with a direction to the respondents to consider the case of the petitioner with regard to recoveries, strictly as per the procedure prescribed under Rule 39 of the H.P. Tourism Development Corporation Limited (Staff) Regulations, 1972, within a period of two months from the date of production of a certified copy of this judgment by the petitioner. It is also made clear that since it is a case of recovery, the petitioner shall be heard in person. No costs.
