JUDGMENT Rajiv Sharma, Judge Petitioner has assailed the appointment of respondent No.6 to the post of Primary Assistant Teacher in Government Primary School, Chulhari, Tehsil Bangana, District Una (Education Block, Bangana). It has come in the reply that the petitioner was not possessing the essential qualifications prescribed for the post in question on the last date prescribed, i.e. 10.1.2006. The interview for the post in question was fixed on 4th May, 2006 and the petitioner qualified the M.Com. Examination only on 18th May, 2006. It is well settled by now that the candidate must possess the essential qualification on the date prescribed in the Rules or in the advertisement. Consequently, since the petitioner herself was not in possession of the essential qualification on the last date prescribed, she cannot be permitted to assail the appointment of respondent No.6 to the post of Primary Assistant Teacher in Government Primary School, Chulhari, Tehsil Bangana, District Una. 2. Accordingly, in view of the above discussion, the present petition is dismissed being devoid of any merit, so also the pending application(s), if any. No costs.
