JUDGMENT Mr. Ajai Lamba, J.: (Oral).- This civil writ petition has been filed praying for issuance of a writ in the nature of certiorari, quashing Order dated 7.8.2007 (Annexure P-2) passed by the Deputy Commissioner, Faridabad. 2. Perusal of Order Annexure P-2 indicates that petitioner Hukam Singh son of Shiv Singh was in possession of Gram Panchayat land unauthorizedly. The petitioner filed an application for allotment of land/ sale of land in his favour. The application has been dismissed vide the impugned order (Annexure P-2). 3. Learned counsel for the petitioner contends that similar application(s) had been filed by other person(s) in unauthorised possession. On remand by this Court, they could project their case before the authorities. Petitioner, however, was in jail undergoing life imprisonment and therefore, could not project his case. 4. I have considered the contentions of learned counsel. 5. Before proceeding further, the purpose for which the land is required to be used would be seen. Land under unauthorised possession of the petitioner is part of a school. Playground is to be provided for benefit of children studying in the school, and therefore, it cannot be disputed that land is required for common purpose. In such circumstances, personal interest must give way. 6. It has been pointed out by learned counsel for respondent No.4 that similar order passed by the authorities came to be challenged before this Court in Civil Writ Petition No.947 of 2008 (Teja Singh vs. State of Haryana & others). Division Bench of this Court has dismissed the said petition with direction to Gram Panchayat, Village Allawalpur, to take possession of the land in question from the petitioner to convert it into a playground to be attached to the village school, without any delay, whatsoever. 7. Learned counsel for the petitioner has not been able to dispute the aforesaid fact. 8. In view of the above, the petition is dismissed with direction to the Deputy Commissioner, Faridabad, to ensure that land in unauthorised possession of the petitioner is taken in possession for onward transmission to the Gram Panchayat. ---------0.B.S.0------------
