JUDGMENT Rajiv Sharma, Case of the petitioner, in a nut-shell, is that he was entitled to be appointed on regular basis as Clerk on compassionate grounds instead of Class-IV employee. Petitioner has averred in the petition that one Ms. Sumitra Devi, though similarly situate, has been appointed as Beldar on regular basis. 2. Mr. A.K. Bansal, learned Additional Advocate General submits that since the petitioner has accepted the post of Class-IV employee on compassionate basis, he is precluded from claiming the post of Clerk. The Court is of the considered view that if similarly situate person, i.e., Ms. Sumitra Devi has been given appointment on regular basis as Beldar, there is no reason why the petitioner has been discriminated against. 3. Accordingly, the petition is disposed of with a direction to the respondents to consider the case of the petitioner for appointment as Clerk on compassionate basis, strictly on the analogy of Ms. Sumitra Devi, within a period of six weeks from the date of production of a certified copy of this judgment by the petitioner. No costs.
