JUDGMENT 1. - Contention of the learned counsel for the petitioner is that petitioner was Saranch in the earlier term for which a false criminal case has been foisted upon him. He was sought to be arrested whereas, in the inspection, which was carried out by the X.En. Shri Pramod Kumar Sharma, it has come out that gravel road was constructed as per specifications rather better standard was found. The sample of gravel was sent to the laboratory in this connection. Shri Pramod Kumar Sharma in his statement recorded under section 161 Cr.P.C. has also corroborated this fact. Learned counsel for petitioner has submitted that challan has already been filed against the other accused and the petitioner under Section 399 Cr.P.C. Petitioner is ready and willing to face the trial. Learned counsel for petitioner in support of his argument has placed reliance on the judgment of Supreme Court in Siddharam Satlingappa Mhetre v. State of Maharashtra & Ors., AIR 2011 SC 312 . 2. Learned Public Prosecutor has opposed the bail application. 3. Having regard to the facts aforesaid and considering all other facts and circumstances of the case, I deem it just and proper to enlarge the petitioner on pre-arrest bail's. 4. In the result, this bail application u/S.438 Cr.P.C. is allowed and it is directed that in the event arrest of petitioner Banshi Lal Meena S/o Shri Nathu Lal Meena in FIR No.20/2010, PS Ayana District Kota (Rural) for offence u/S.409 IPC, he be released on bail by the SHO/IO on his furnishing a personal bond in the sum of Rs. 30,000/- together with two sureties in the sum of Rs. 15,000/- each to his satisfaction with the following conditions: 1. that the petitioner shall make himself available for interrogation by a police officer as and when required; 2. that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and 3. that the petitioner shall not leave India without previous permission of the court.
