JUDGMENT 1. - Heard learned counsel for the parties. 2. By this writ petition, the petitioner has challenged the order-dated 26.12.2006 (Annexure/7) of deferment of grant of selection scales on completion of 9 and 18 years of service. 3. Counsel for the petitioner submits that petitioner is working on the post of Biogas Mistry Gr.l and was granted Ist and IInd selection grade vide order-dated 1.10.2005 but on the ground of pendency of writ petition No. 5390/1995, the respondents have deferred the benefit of 9 and 18 years for grant of selection scales to him. Counsel further submits that the said writ petition No. 5390/1995 along with two other writ petitions has been allowed by the Coordinate bench of this Court on 1.9.2009, therefore, the said ground of pendency of the writ petition referred in the order-dated 26.12.2006 (Annexure/7) is no more survives. 4. Counsel for the respondent-State has not disputed the aforesaid factual as well as legal position. 5. The relevant portion of the judgment passed in S.B. Civil Writ Petition No. 5390 of 1995, Bhanwar Lal Verma & Ors. v. State of Raj. & Anr. along with 2 other connected writ petitions runs as under - "In the result, these writ petitions are allowed. The impugned orders dated 9.11.1995, 10.11.1995, 20.11.1995 and 22.11.1995 are quashed and set aside. The petitioners are held entitled to receive salary in the pay scale of Rs. 1400-2600/- w.e.f. 1.9.1998 and they are further held entitled to such salary in that pay scale throughout or in the corresponding pay scale In the subsequent Revised Pay Scale Rules. Since the recovery orders have in these cases remain stayed pursuant to stay order passed by this Court, such recovery order would stand quashed. Petitioners are also entitled to receive selection scale from the date of their absorption/substantive appointment in the absorbing department in terms of Government circular dated 25.1.1992/17.2.1998. In case, any arrear is found payable to them, the same would be paid to the petitioners with interest @ 6% per annum. Compliance of this judgment be made within three months from the date its copy is produced before the respondents. Parties shall bear their own costs." Accordingly, the writ petition is allowed. The order-dated 26.12.2006 (Annexure/7) so far as the ground of deferment of grant of selection scales to the petitioner on completion of 9 and 18 years service is concerned, the same does not survive. The respondents are directed to grant selection scales as per the order-dated 01.10.2005 to the petitioner within a period of one month from the date of receipt of the copy of this order. 7. The application No. 44248 dated 3.11.2010 filed by the counsel for the petitioner to decide the writ petition in terms of the order in the identical writ petition Nos. 5390/1995, 1156/1997 and 55711997 decided on 1.09.2009 is also disposed of.Writ Petition Allowed. *******
