JUDGMENT Mr. Alok Singh, J (Oral). - Petitioner was found guilty under Sections 279/337/338/304-A of the Indian Penal Code and was sentenced to undergo rigorous imprisonment for a period of three months under Section 279 IPC, to undergo rigorous imprisonment for a period of three months under Section 337 IPC, to undergo rigorous imprisonment for a period of six months and to pay fine of Rs.500/- and in default of payment of fine to further undergo rigorous imprisonment for a period of one month under Section 338 IPC and to undergo rigorous imprisonment for a period of one year and to pay a fine of Rs.500/- and in default of payment of fine to further undergo rigorous imprisonment for a period of one month under Section under Section 304-A IPC. 2. At the outset, learned counsel for the petitioner does not challenge the conviction of the petitioner and submitted that the petitioner has already remained in custody for about three months during the pendency of this case and he has suffered a lot of embarrassment owing to the pendency of this criminal case. 3. I have heard learned counsel for the parties and gone through the record. The present case was registered against the petitioner for offence under Sections 279/337/338/304-A of the Indian Penal Code. The sword of Damocles is not to hangover the head of the petitioner for all times to come. He has suffered mental agony due to registration of this criminal case against him. The petitioner has already undergone sentence for about three months in this case. 4. Considering totality of the facts and circumstances of this case while maintaining the conviction of the petitioner, the petitioner is sentenced to undergo sentence for the period already undergone by him in this case. However, accused/petitioner shall deposit compensation of Rs.50,000/-, under Section 357 Cr.P.C., over and above the compensation, if any, granted by the MACT, in the trial Court to be paid to the legal representatives of the deceased and the injured, within 30 days from today, failing which present petition shall be deemed having been dismissed. Out of the aforesaid amount of Rs.50,000/-, Rs.40,000/- would be paid to the legal representatives of the deceased and rest of the amount would be paid to the injured, equally. In the event of deposit by the accused, learned trial Court shall issue notice to the L.Rs.
