JUDGMENT S.S. Saron, J.:- Heard learned counsel for the parties. 2. The petitioner Bikramjit Singh seeks regular bail in a case registered against him on 19.4.2010 in respect of the incident that occurred on 11.4.2010. 3. The FIR in the case has been registered for the offences under Sections 307, 323, 148 and 149 IPC. In the incident that occurred on 11.4.2010 at 1.45 p.m., the complainant Yadwinder Singh was going from Boaprai to Batala in a bus. When the bus reached on the turn of Basarpura, Bikramjit Singh and Davinder Singh stopped the vehicle while standing in front of it. When the bus stopped, the complainant was standing on the back door of bus. Saminder Singh @ Sherry, Harpreet Singh @ Happy and Sabba armed with ‘datars’ and two-three more unknown persons were armed with datars and kirpans came out from the Qualis vehicle. Bikramjit Singh (petitioner) and Devinder Singh took out ‘kirches’ from the car. Bikramjit Singh (petitioner) raised lalkara that the complainant insulted him for not taking the bus ticket and he should not be spared. Then the said persons pulled the complainant down from the bus. The petitioner is stated to have given a `Kirch’ blow on the right hand of the complainant, which he raised in his defence and his finger got chopped of. The complainant Yadwinder Singh has suffered 13 injuries as per the MLR (Annexure-P.2). 4. Learned counsel for the petitioner submits that the name of the complainant in the MLR (Annexure P2) has wrongly been mentioned as Jaswinder Singh, whereas it should have been Yadwinder Singh. Injury No.1 in the MLR (Annexure-P.2) which is attributed to the petitioner has been mentioned as an incised wound on the inner side of right hand starting 6 cm. above the wrist joint to down ward of whole hand with amputated little finger of right hand. As per X-ray report (Annexure-P.3), X-ray on right hand AP and LAT views, it has been mentioned as amputation of little finger along with both Phalanx first metacarpal seen. The petitioner, however, is in custody since 20.5.2010. The complainant Yadwinder Singh has since been discharged from the hospital. Though, the case has been registered for the offence under Section 307 IPC, however, it has not been shown as to which injury has been opined by the doctor to be dangerous to life.

The involvement of the petitioner is to be established by the prosecution by leading evidence. The trial in the case is likely to take time. The injury that is attributed to the petitioner is quite serious but is on a nonvital part. However, the petitioner has been in custody for the last more than nine months. 5. In the facts and circumstances, the petitioner on his furnishing personal bond and surety to the satisfaction of the learned Chief Judicial Magistrate, Gurdaspur shall be admitted to bail.
