ORDER This Civil Revision Petition arises out of Order, dated 01-06-2011, in IA.No.536 of 2010 in OS.No.1054 of 2009, on the file of the learned XII Junior Civil Judge, City Civil Court, Hyderabad. 2. The petitioner is the defendant in the aforesaid suit, filed for declaration and mandatory injunction by the respondent herein and the Court below granted an interim order of status quo on 24-02-2010. Subsequently, the plaintiff filed interlocutory application being IA.No.536 of 2010 to receive certain documents in order to mark them as exhibits in the suit and the same was allowed. Aggrieved thereby, the petitioner filed the present Civil Revision Petition. 3. Heard the learned Counsel for the petitioner and perused the record. 4. A perusal of the affidavit filed in support of the IA shows that, even though the interim order of status quo was subsisting, the petitioner herein continued with the alleged illegal construction and as such, the respondent made complaints to the Assistant City Planner and Commissioner of the Municipal Corporation of Hyderabad on 26-02-2010 and the Police Officials concerned on 13-05-2009, which• were duly acknowledged. The respondent wanted to mark those documents as exhibits in the suit. 5. By the order impugned herein, the above documents were received to place on record. It is always open for the petitioner defendant to raise his objection, if any, as to the relevancy or admissibility of those documents at the stage of marking those documents. But mere receipt of documents cannot be said to be acceptance of the same as evidence. Therefore, I do not find any reason to interfere with the order under revision and hence, the revision petition is liable to be dismissed. 6. Accordingly, the Civil Revision Petition is dismissed. No order as to costs.
