JUDGMENT Kurian Joseph, J. The petitioner is a beneficiary of Annexure P-1, award passed by the H.P. Labour Court, Shimla in Ref. No. 202 of 2003. It has been held that the petitioner shall be entitled to reinstatement with seniority and continuity in service. Therefore, the period he has been kept out shall be counted for all purposes except the actual back wages, which has otherwise been dealt with in the award. Therefore, this writ petition is disposed of making it clear that in view of the award regarding entitlement of continuity and seniority, the petitioner shall be entitled to count the service for the purpose of conferment of work charge status. Needful shall be done within a period of four months from the date of production of a copy of this judgment alongwith copy of the writ petition by the petitioner before the second respondent. 2. The writ petition is disposed of, so also the pending application(s), if any.
