ORDER : 1. The three respondents were convicted by the Trial Court under Section 396 of the Penal Code; one of them, Nand Kishore Singh was awarded death sentence while the other two, Maheshwar Singh and Mintu Kumar @ Mintu Singh were sentenced to life imprisonment. 2. In appeal, the High Court maintained the conviction of Mintu Kumar @ Mintu Singh but found him to be a juvenile on the date of occurrence. Giving him, therefore, the benefit of Section 7A of the Juvenile Justice Act, the sentence awarded to him by the Trial Court was held to be of no effect and he was directed to be forwarded to the Juvenile Board for passing an appropriate order. In regard to the other two, the High Court set aside the judgment of the Trial Court and they were acquitted of the charge. 3. Against the High Court order, the informant came to this Court and was granted permission to file special leave petitions by order dated January 9, 2009. He has now filed these petitions (Crl.M.P. Nos.2835-2838/2011) for withdrawal of the special leave petitions. 4. The proceedings of a criminal case, specially of this nature cannot depend on the whims of the informant. 5. The prayer for withdrawal of special leave petition is rejected. Having regard to the changed attitude of the informant, the Registry of this Court is directed to appoint an Amicus Curiae in this case. 6. The special leave petitions shall proceed in usual course.
