Judgment : The Court : Alleging that though they are entitled to get supply of electricity the licensee has failed and neglected to give supply, the petitioners have brought this petition under art.226. Mr. Chatterjee appearing for the petitioners has submitted that all amounts demanded by the licensee have since been deposited, and that the petitioners are ready and willing to comply with all formalities for getting construction power and permanent connections for domestic and commercial purposes. Mr. Panja appearing for the licensee has submitted as follows. Within 48 hours from the moment the formalities including submission of application in prescribed form are complied with for construction power, supply of such power will be effected by the licensee. Within a week from the date all formalities are complied with and charges, if any, are paid for permanent connections for domestic and commercial purposes, the licensee will effect such supplies. For installation of transformer the petitioners are required to erect certain constructions. Mr. Chatterjee has said that the petitioners will comply with all formalities for getting temporary and permanent connections. In view of the above-noted situation, this petition is disposed of ordering as follows. Within 48 hours from the moment the petitioners comply with all formalities and pay charge, if any, for construction power, the licensee shall effect such supply. Within a week from the date the petitioners comply with all formalities and pay charge for permanent domestic and commercial connections, the licensee shall effect such supplies. No costs.
