Judgment :- 1. The petitioner has approached this Court with a prayer for issuance of a writ in the nature of mandamus directing the respondents to sanction the educational loan to the petitioner with respect to the B.Sc.(Nursing) in Noor College of Nursing, Bangalore within a time frame fixed by this Court. 2. The application of the petitioner has not been considered by the respondents on the ground that the petitioner did not have 50% marks required under the Educational loan scheme and also on the ground that the loan applied by the petitioner cannot be granted as the petitioner has already completed two years whereas only two years are remaining to complete the Course. 3. The educational loan scheme circulated in April 28, 2001 provides that the condition of minimum qualifying marks in the last examination is dropped. Therefore, the stand of the learned counsel for the respondents, that the petitioner is not entitled to educational loan for not having scored 50%, marks in the previous examination cannot be sustained. 4. However, the learned counsel for the respondents is right in contending that only two years are remaining in the Course, the respondents are willing to consider the application for educational loan of the petitioner for her study of remaining two years. 5. In view of the stand taken by the learned counsel for the respondent-Bank, this writ petition is disposed off by directing the respondent-Bank, to consider the application of the petitioner and grant her educational loan for two years, based on the fee structure. 6. The needful be done within 15 days of the date of receipt of certified copy of this order. No costs.
