This petition under Section 407 of the Code of Criminal Procedure has been filed by the petitioners M/s Pal Infrastructure and Developers Pvt. Ltd. & Ors., for the transfer of the criminal complaints filed under Section 138 of the Negotiable Instruments Act, against them by the respondents from different Courts at Gurgaon and Faridabad to one criminal Court at Gurgaon. 18 such complaints are detailed in Annexure P/1. It is not disputed between the parties that all these complaints have been filed in respect of the cheques, which were issued in connection with the agreement entered into between them and which has been annexed with the present petition as Annexure P/2. According to the learned counsel for the respondent two other complaints in respect of the cheques given under that agreement are also pending between the parties in the Court of Sh. Mukesh Rao, JMIC, Gurgaon. All these complaints between the parties arising out of the same agreement, for fair trial, are to be decided by one and the same Court. Learned counsel for the parties have no objection if all the complaints pending between the parties in different Courts are ordered to be heard and decided by the same Court. As per the contents of the agreement, all the disputes arisen between the parties are to be decided by the Courts at Faridabad/Delhi alone. The interest of justice requires that all these complaints be transferred to one Court at Faridabad. Accordingly, the complaints described at Sr.No. 1 to 4 and 18 are withdrawn from the file of Sh. Sunil Chauhan, JMIC, Gurgaon, the complaints mentioned at Sr. No. 11 to 17 are withdrawn from the file of Ms. Mona Singh, JMIC, Faridabad and complaints mentioned at Sr. No. 19 and 20 are withdrawn from the file of Sh. Mukesh Rao, JMIC, Gurgaon, are transferred to the Court of Sh. Sunil Chauhan, JMIC, Gurgaon, the complaints mentioned at Sr. No. 11 to 17 are withdrawn from the file of Ms. Mona Singh, JMIC, Faridabad and complaints mentioned at Sr. No. 19 and 20 are withdrawn from the file of Sh. Mukesh Rao, JMIC, Gurgaon, are transferred to the Court of Sh. Lokesh Gupta, JMIC, Faridabad, for deciding the same in accordance with law. The parties are directed to appear in that Court on 5.5.2011. The petition is disposed of accordingly. ----------------
