Judgment : The Court: The matter appears to have been resolved in principle between the parties. The subject-matter of the suit is a valuable property in Camac Street in the heart of the business district. The plaintiffs have agreed, in principle and without prejudice to their rights and contentions, to extend the tenure of the defendants’ occupation of the property for the purpose of a petrol pump being run thereat. The only dispute that remains unresolved is the payment due on account of rent from or about 1982 and the interest payable thereon. The defendant Oil Corporation has offered to make payment of the principal sum due on account of rent but says that it is not liable to pay any interest. The plaintiffs wish to pursue their claim for eviction unless the interest part is paid. This is a matter which requires intervention at the highest level of the defendant Corporation. The defendant runs the risk of protracted litigation and an ultimate possibility of being divested of a prime property merely on the defendants’ refusal to pay interest on the rent due to the plaintiffs. This order will be brought to the notice of the chairman of the defendant Oil Corporation for a decision to be rendered on the matter before the matter is next taken up four weeks hence. Urgent certified photocopies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
