ORDER : R.V. Raveendran, J. Being of the view that an independent assessment of the present situation and condition of the factory will be necessary, by order dated 25-2-2011 Sterlite Industries (I) Ltd. v. Union of India, (2011) 13 SCC 769 , we appointed NEERI to make a pollution and environment impact assessment and submit its report. In pursuance of it, NEERI has inspected the factory and submitted its report containing the assessment of environmental pollution. 2. The first respondent in SLP (C) No. 28119 of 2010 has filed his comments/objections in regard to the NEERI report. The first respondent in SLP (C) No. 28123 of 2010 (National Trust for Clean Environment) seeks time to file their comments in regard to the NEERI report. 3. The writ petitioners, who are the respondents here, are directed to file a consolidated synopsis of their objections/comments with reference to the NEERI report. The Tamil Nadu Government as also TNPCB are directed to submit their comments/suggestions with reference to the NEERI report. In particular, TNPCB to submit a report particularly with reference to the NEERI suggestions/comments/recommendations so that this Court can have a clear view about the existing position. The respondents who have not filed their counter-affidavits, are permitted to file them by 5-8-2011. 4. List on 10-8-2011. Interim stay to continue till then.
