JUDGMENT 1. - This writ petition has been filed assailing the order passed by the District Collector, Jaipur dated 17/8/2009 (Ann.7) by which revision petition filed by private respondents No.3 to 5 has been allowed and the matter has been remanded back to the Gram Panchayat for providing opportunity of hearing to the petitioner as well as the respondents giving them liberty to adduce evidence and also make special inquiry about the possession and construction on the land in question. 2. Contention of Shri Hanuman Choudhary, learned counsel for the petitioner is that this Court while issuing notices to the respondents on 12/10/2009 was persuaded to pass interim-order of status-quo because construction of the house of the petitioner was available on the disputed land and he also obtained electric connection and that pakka house has been constructed. It is argued that petitioner is in possession of the disputed land for last more than five decades. Revision petition was filed by way of afterthought with the delay of three years. Learned counsel for petitioner submits that patta issued to the petitioner by the Gram Panchayat on 12/8/2005 was registered by the Sub Registrar Sanganer-II Jaipur. 3. Shri S.D. Khaspuria, learned Additional Government Counsel opposed the writ petition and has argued that remand has been made by the learned Collector after hearing all the parties and considering the fact that number of different provisions of Rule 140 to Rule 168 of the Rajasthan Panchayati Raj Rules, 1996 were not followed. By the impugned-order, learned Collector has simply remanded the matter back to the Gram Panchayat for making appropriate inquiry as to the possession and the age of construction of the house. Petitioner should approach the Gram Panchayat and satisfy the Gram Panchayat about his old possession and existing construction and electricity connection etc. Writ petition should not be entertained. 4. Having regard to the facts of the case, when petitioner is claiming to have the house constructed and which fact has been ordered to be verified on remand by the Gram Panchayat, while not interfering with the impugned-order of remand, I direct that the status-quo order, which was passed by this Court on 12/10/2009 shall continue till any fresh decision is taken by the Gram Panchayat in regard to issuance of the patta to the petitioner. 5.
5. Writ petition is therefore disposed of with direction to the Gram Pancyayat to take fresh decision within a period of three months from the date copy of this order is produced before it.Petition disposed of. *******
