JUDGMENT Kurian Joseph, J. The Writ Petition is filed with the following prayer: “i) That the respondents may be ordered to sanction ‘pro-rata’ pension in favour of her late husband of the petitioner w.e.f. the due date and they may further be ordered to pay all arrears to the petitioner being legal heir/nominee of her late husband with interest at the rate of 7 ½ % per annum.” 2. It is seen that the issue, in principle has already been decided by this Court by various judgments and one judgment is in CWP(T) No. 5728 of 2008. It is not in dispute that the principle has been accepted and the judgment has been implemented. In case the petitioner is similarly situated, the petitioner may not be discriminated. 3. Therefore, there will be a direction to the 2nd respondent to look into the matter and take appropriate action, without discriminating the petitioner, within 4 months on production of a copy of this judgment alongwith a copy of the writ petition by the petitioner. 4. The Writ Petition is disposed of, so also the pending application(s), if any.
