Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the first respondent to take suitable action against the respondents 2 to 4, particularly respondents 3 and 4 based upon the complaint/representation dated 3.1.2011 by petitioner to the first respondent and consequently forbear the respondents 2 to 4 from illegally exploiting the fishing rights in Kollapatty Saklian Kuttai lake water situated in Mallasamuthram village, Thiruchengodu Taluk, Namakkal District. 2. Mr.L.S.M.Hasan Fizal, learned Government Advocate, takes notice on behalf of the first respondent. Considering the nature of order that is to be passed in this writ petition, notice to the respondents 2 to 4 is dispensed with. By consent of both parties, the writ petition is taken up for final disposal. 3. Petitioner has given a complaint/representation dated 3.1.2011 to the first respondent stating his grievance. Postal acknowledgment signed on behalf of the first respondent is also filed along with the typeset of papers. Since no action has been taken so far, the writ petition has been filed. 4. Learned Government Advocate states that the first respondent will consider the complaint/representation of the petitioner if it is otherwise in order. 5. Considering the nature of relief sought for in the writ petition and also the submission made by the learned Government Advocate appearing for the first respondent, the first respondent is directed to consider and dispose of the complaint/representation dated 3.1.2011 on its own merits and in accordance with law expeditiously. Before considering the complaint/representation, the first respondent shall issue notice and give sufficient opportunity to the respondents 2 to 4 to submit their case, if any action is contemplated against them. The writ petition is ordered as above. No costs. Consequently, connected miscellaneous petition is closed.
