ORDER : 1. Heard learned counsel for the petitioner and the State. 2. It is submitted on behalf of the petitioner that Public Distribution Licence (PDS) No. 5 of 1988 was cancelled by the Sub-Divisional Officer, Kahalgoan, District- Bhagalpur on the basis of certain allegation. Petitioner appealed against the aforesaid order vide Miscellaneous Supply Appeal Case No. 82/2009-2010 which stood dismissed by order dated 19.05.2011 passed by the Collector, Bhagalpur (Annexure-1). 3. Learned counsel for the State submits that petitioner has approached this court without exhausting the statutory remedy of revision before the Divisional Commissioner and further legal remedy available under the amended provisions of Paragraph -15 of the Public Distribution System (control Order) 2001. 4. Learned counsel for the petitioner submits that petitioner proposes to file a revision before the District Collector, Bhagalpur. 5. Considering the submissions of the parties, it is directed that in case petitioner files a revision application before the District Collector, Bhagalpur within a period of four weeks alongwith certified copy of the present order, the revisional application be considered expeditiously, preferably within a period of four months in accordance with law on merits. 6. The writ application stands disposed of.
