JUDGMENT 1. - By this petition for writ the petitioner is claiming appointment with the respondent-Municipal Board on compassionate grounds. 2. The factual matrix necessary to be noticed is that the father of petitioner Shri Prakash died on 10.2.2007, while serving with respondent Municipal Board as Safaiwala. Smt. Kamla, widow of late Shri Prakash and mother of petitioner submitted an application on 7.3.2007 making a request to the competent authority of Municipal Board to accord appointment to the petitioner on compassionate grounds. No action thereupon was taken, hence this petition for writ is preferred. 3. A reply to the writ petition is filed with assertion that for claiming appointment on compassionate grounds an application in accordance with Rajasthan Compassionate Appointment of Dependents of Deceased Government Servant Rules, 1996 (hereinafter referred to as 'the Rules of 1996') is required to be filed but no such application in prescribed format was filed, as such, the case of petitioner for grant of appointment in accordance with the Rules of 1996 was not considered. 4. The deficiency pointed out is technical one and not pertaining to the merits, as such, I deem it appropriate to dispose of this petition for writ by directing the respondents to consider case of the petitioner for grant of appointment on compassionate grounds in accordance with the Rules of 1996 if the petitioner submits an application in the prescribed format within a period of two months from today. On consideration, if the petitioner is found eligible in accordance with the Rules of 1996, then appointment shall be accorded to him within a period of one month thereafter.Petition Allowed. *******
