Judgment :- 1. Heard the learned counsels appearing for both sides. 2. It has been submitted that the petitioner is the owner of a TVS Scooty bearing Registration No.TN-54-D-3035. On 24.1.2012, the Inspector of Police, Kitchipalayam Police Station, Kitchipalayam, Salem District, had seized the vehicle stating that the petitioner had committed an offence by transporting the TASMAC liquor bottles. Thereafter, the petitioner had approached the Judicial Magistrate-II, Salem, for the return of the vehicle. However, the respondent had stated that the TVS Scooty, said to be belonging to the petitioner, had not been produced, under Form-95, before the Judicial Magistrate-II, Salem, as they were taking steps to adjudicate upon the matter, under Section 14(4) of the Tamil Nadu Prohibition Act, 1937, for the confiscation of the vehicle. In such circumstances, the petitioner had preferred the present writ petition, before this Court, under Article 226 of the Constitution of India, praying for a writ of Mandamus to direct the respondent to release the TVS Scooty vehicle, bearing registration No.TN-54-D-3035, said to be belonging to the petitioner. 3. The learned Additional Government Pleader appearing for the respondent had submitted that the vehicle in question had been seized, under Section 13 of the Tamil Nadu Prohibition Act, 1937. Steps had been taken by the authorities concerned to adjudicate upon the matter to confiscate the vehicle in question. 4. In view of the submissions made by the learned counsels appearing for the parties concerned, this Court finds it appropriate to direct the petitioner to approach the respondent, by making an appropriate representation to release the vehicle, by participating in the adjudication proceedings. Thereafter, it would be open to the respondent to pass appropriate orders, as per law, as expeditiously as possible. The writ petition is ordered accordingly. No costs.
