Judgment Common Order 1. The petitioners have approached this Court with a prayer for issuance of a writ in the nature of Mandamus, to direct the respondents 1 to 3 to consider the petitioners for appointment to the post of Live Stock Inspector. 2. The petitioners are graduates in B.Sc., Rural Development Science with specialization in Animal Husbandry and belong to Scheduled Caste. The petitioners got themselves registered with the employment exchange on 20.08.1990 and 08.02.1999. 3. The case of petitioners is that advertisement was published on 29.09.2001, for recruitment of 250 Live Stock Inspectors through District Employment Office throughout Tamil Nadu. The petitioners, being fully eligible, their names were forwarded to the respondents, by the employment exchange. 4. The Chairman and Secretary called only +2 passed candidates and ignored the persons, who were holding the degree of B.Sc., Rural Development Science, with specialization in Animal Husbandry from zone of consideration. 5. The petitioners, therefore, challenged the action of respondents in not considering the case of petitioners, on the ground of their having higher qualification, than the one advertised. 6. Learned Tamil Nadu Administrative Tribunal, at the time of admission of the cases, by way of interim direction, had directed the respondent nos.1 to 3 to consideration the application of petitioners for appointment to the post of Live Stock Inspectors. 7. The stand of respondents is, that the petitioners could not be interviewed, as a decision was taken not to fill up 250 posts of Live Stock Inspectors. The learned counsel for the State submits that reason for not holding the interview was, that decision was taken to stop training in Animal Husbandry department. 8. In the counter, it is specifically pleaded that in future, if the post of Live Stock Inspector, is to be filled and selection commences, the interview will be conducted to the post, and candidates sponsored by the District Employment Exchange only will be considered including the petitioners. 9. In view of the stand taken in the counter, that no post was filled, the relief claimed by petitioners, cannot be granted, as it is for Government to fill up the posts. The petitioners can claim right of consideration with other eligible persons as and when posts are filled. It is made clear in counter that as and when posts are filled, all including petitioners will be considered. 10. No merits. Dismissed. No costs.
