Judgment :- 1. This writ petition has been filed praying for the issuance of a Writ of Mandamus directing the respondent herein to return the petitioner's Driving Licence bearing No.DL No.TN 36 19940001950 which is valid upto 07.08.2012, forthwith. 2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing on behalf of the respondent. 3. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the respondent had placed before this Court a letter, dated 27.02.2012, issued by the respondent stating that the respondent had issued a show cause notice to the petitioner, under Section 19 of Motor Vehicles Act, 1988, for causing an accident, punishable under Section 304(A) of Indian Penal Code. A First Information Report had been filed, in Crime No.25 of 2012, on the file of Chithode Police Station, Chithode, Erode District. 4. It had been further stated that the petitioner had received the show cause notice, on 02.02.2012. On receipt of the show cause notice, the petitioner had prayed for further time of fifteen days to offer his explanation. By a letter, dated 14.02.2012, the petitioner had offered his explanation. The explanation submitted by the petitioner is under consideration by the authority, who would be passing an appropriate order in due course. 5. In such circumstances, in view of the statements made by the respondent, in his letter, dated 27.02.2012, the respondent is directed to consider his explanation submitted by the petitioner in his letter, dated 14.02.2012, and pass appropriate orders thereon, on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order, after giving an opportunity for personal hearing to the petitioner. 6. Accordingly, this writ petition is ordered with the above directions. No costs.
