Judgment :- 1. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent. 2. This writ petition has been filed praying for a Writ of Mandamus to direct the respondent to consider the representation of the petitioner, dated 18.1.2012, and to pass appropriate orders thereon, to retain the Tamilnadu State Marketing Corporation Shop No.5638, located at Door No.3A, Uththriya Mada Koil Street, Velankanni, Keezhvelur Taluk, Nagapattinam District. 3. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the respondent had placed before this Court an order, dated 14.6.2011, passed by the First Bench of this Court, in W.P.No.6217 of 2011, directing the District Collector, Nagapattinam District, to consider and dispose of the representation filed by the Lodge Owner's Association, Kilvelur Taluk, Nagapattinam District and to pass appropriate orders thereon, after giving an opportunity of hearing to the parties concerned. Pursuant to the said order, the District Collector, Nagapattinam District, had passed the order shifting the Tamilnadu State Marketing Corporation Shop No. 5638, located at Door No.3A, Uththriya Mada Koil Street, Velankanni, Keezhvelur Taluk, Nagapattinam District, to another place. Thereafter, the said shop had been shifted, by an order, dated 15.2.2012, issued by the respondent, in the present writ petition. 4. In such circumstances, the present writ petition, filed by the petitioner, has become infructuous. Hence, it is dismissed, as infructuous. No costs.
