Judgment 1. This writ petition is filed to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order of the first respondent in G.O.(1-D) No.98 School Education (D-2) Department, dated 2.5.2001 and quash the same and direct the third respondent to promote the petitioner as BT Assistant as per the order of the second respondent dated 27.5.1992 in the place of the fourth respondent with effect from the date of appointment of the fourth respondent and grant him all consequential benefits. 2. The petitioner seeks to quash the order of the first respondent and to permit the petitioner as B.T. Assistant in the place of fourth respondent. 3. Learned counsel for the petitioner now states that the petitioner was 51 years at the time of filing the writ petition and he would have super-annuated by this time. No interim order was granted at the time of admission. 4. In such view of the matter, the relief sought for by the petitioner has become infructuous due to efflux of time. Accordingly, the writ petition is closed. The petitioner is however given liberty to seek any other relief if permissible under law.
